Legal to do what they did? (two part question)?
On the A&E’s TV show Intervention in 2007 on the Episode about the 20 year old Dillion who lives with his father in a trailer and uses methamphetamine every day during the intervention the interventionist threatens to send Dillon with the police and have them charge him with public intoxication and have his phone records sent to the police so they could arrest his “drug dealer/drug friends”. (a) Is it legal for them to do that?
(b)Also, is it legal for the police to let someone go who they know is under the influence of methamphetamine?
A. Yes, they can make that threat. They can also follow through with it.
B. Yes, the police have discretion to let an intoxicated person go, no matter the source of the intoxication.
